1. Acceptance of Terms
By downloading, installing, or using the APEX AI Coach mobile application ("APEX," "the App," "we," "our," or "us"), you agree to be bound by these Terms of Use and End User License Agreement ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms apply to all users of APEX, including coaching clients and Walk + Water Challenge participants.
2. Description of Service
APEX AI Coach is a personal fitness and wellness application that provides:
Access to certain features requires a coaching arrangement with Coach Josh Saunders, initiated by booking a 1-on-1 call. Access to Walk + Water Challenge premium features requires an active subscription as described in Section 4.

To use APEX, you must create an account using a valid email address. You are responsible for:

4. Subscriptions & In-App Purchases
APEX offers auto-renewable monthly subscriptions for Walk + Water Challenge premium access. All subscriptions are processed through Apple's App Store.

Price: $7.99 per month (normally $19.99) · Auto-renews monthly
Available upon completion of the 3-Day Walk + Water Challenge.
Walk + Water Challenge Membership — Extended Challenge Offer
Price: $9.99 per month (normally $19.99) · Auto-renews monthly
Available upon completion of a 7-day, 14-day, or 21-day Walk + Water Challenge.
All subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Payment is charged to your Apple ID account at confirmation of purchase.
You can manage and cancel your subscription at any time in your iPhone or iPad Settings under your Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period — you retain access until then.

5. Free Trials & Introductory Offers
Introductory pricing (the $7.99 and $9.99 offers) is available only to new subscribers and is tied to challenge completion. Only one introductory offer may be applied per Apple ID.
If an introductory offer is available, the terms will be displayed clearly at the point of purchase before you confirm. After any introductory period ends, the subscription renews at the standard or offered price disclosed at checkout.
6. Refunds
All purchases are processed by Apple. Refund requests must be submitted directly to Apple through Apple's standard refund process at reportaproblem.apple.com. We do not have the ability to issue refunds directly for App Store purchases.
7. Health & Fitness Disclaimer
APEX is a fitness and wellness tool, not a medical service. The app's content, including AI Coach responses, workout plans, nutritional guidance, and challenges, is for general wellness purposes only and does not constitute medical advice, diagnosis, or treatment.
Consult a qualified healthcare professional before beginning any new exercise or nutrition program, especially if you have a pre-existing medical condition, injury, or health concern. You use the App and follow any guidance entirely at your own risk.

APEX includes an AI-powered coach that uses large language models to generate responses. You acknowledge that:

10. Intellectual Property
All content within APEX — including the app design, workout programs, challenge content, AI prompts, branding, and text — is owned by or licensed to APEX AI Coach and is protected by applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use in accordance with these Terms. No other rights are granted.
11. User-Generated Content
If you post content to the in-app Community feed or submit form review videos, you grant us a non-exclusive, royalty-free license to display that content within the App. You retain ownership of your content and are solely responsible for it.
Form review videos submitted to coaches are used only for coaching purposes and are not shared publicly.
12. Privacy
Your use of APEX is also governed by our Privacy Policy at apexai.coach/privacy, which is incorporated into these Terms by reference.
13. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion, with or without notice. Upon termination, your right to use the App ceases immediately.
You may delete your account at any time by contacting us at the address below. Deleting your account does not automatically cancel any active App Store subscriptions — you must cancel those separately through your Apple ID settings.
14. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
15. Limitation of Liability
To the maximum extent permitted by applicable law, APEX AI Coach and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.
16. Governing Law
These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Arizona.
17. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms.
